Law Enforcement Officer, government agency

Has the time come for the U.S Second Amendment to be repealed or amended?

After yesterdays tragic shooting in Newtown CT and the worst year ever for firearm related deaths and mass killings , has the time for the US Government to tell the Gun Lobby it is over and repeal or amend "the right of the people to bear arms".

Should it be repealed on the grounds that when originally written it was for a smaller population to defend the "State" and meant for Muskets and flintlocks not semi automatics and military hardware, which makes it no longer viable on account of relevance to this day and age.

That Militia should be held to Law Enforcement agencies, Military and government controlled Para military agencies, with a show need, clause for people such as certain Primary producers etc.

Is it time to tell the NRA and the Gun Lobby there will be no more "collateral" damage no matter how much you donate to the "Party"

What would be the best way for the government to enforce such a law???

And please no Guns do not kill people, people kill people debates it was people who invented firearms in the first place.

The time has come to realise it is mainly our children who pay the ultimate price for lack of diligence in monitoring a problem that has been there for far too many years.

Closing Statement from Morgan Barnes

Firstly I would like to say I did not flag or delete anyone's comments I am perfectly capable of speaking for myelf however I did get frustrated and had some comments deleted myself.
As I write this President Obama has signed 23 executive orders inline with Colleen's post from yesterday from New York.

I have to admit I am a little disappointed that we could not of just discussed the issue in a more calm, critical and logical manner and be able to offer solutions as well as recognised the underling causes, as this is a forum for open ideas and thinking, Then again we are dealing with human nature.
To those of you from the International community thank you for your imput and allowing people to see the different views helds in different parts of the world on this subject.
I will not deny that the Constitution and The Bill Of Rights are the backbone of America, but remember it was written by man not given by god and man can take it away or amend it, if he really wants too.
I am a believer that in the 21st Century we should use it to advance humankind to address the problems of the world and improve it for all. It won't be easy but we have to start somewhere or we risk implementing our own destruction.
I hope that this be a positive start and and an even more positive step in which the US can show the way.
Once again I thank you all for your contributions

Dec 24 2012: The 2nd Amendment reads "A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed."

What this implies, and what we Americans forget, is that it means that yes, the people have the right to bear arms, but we also bear teh responsibility of making absolutely certain that we have a society that knows what those arms are for.

They are for the security of our persons and our property. They are not for Jokers to slaughter moviegoers or for psycho richboys to kill kindergarteners. If we want to keep our second amendment protection, then we as a country need to deal with the issues of the growing number of psychotic shooters - just heard another on the news this morning, 2 firefighters dead battling a blaze in New York.

This is not the time for gun owners to cling to their Glocks citing their freedom. Their freedom is in danger because they have not stood up to create a culture of gun safety, gun responsibility, and the knowledge of guns as a tool and not as a phallic extension of their erroneous manhood.

Yes, the second amendment was put in place to make sure that the American people would never be forcibly suppressed by the government. But it was not put there so we could think childishly in terms of "good guys vs. bad guys"

Therefore, if we want to keep our precious freedoms, we must make ourselves again worthy of those freedoms.

Dec 24 2012: "shall not be infringed" means "shall not be infringed" as in "not subject to the passing whims of the populace" at any given time.
You will need to find a solution to your social problems, by another means.

Perhaps you can train your children to treat other children who may have impaired minds, with kindness. Perhaps you can advocate and make sure that your community has good mental health services. Perhaps you can make sure your very expensive schools don't turn a blind eye to a child who is mentally deficient and allow him to slither along the walls in some type of mental torment, doing nothing about it, as we now learn was the case with Adam Lanza in this idyllic community.

Before you use gun ownership as a scapegoat, don't you have a lot of other, very doable things that you have neglected to take care of? Oh, and don't forget a mass boycott of the mental cess from Hollywood and in particular, the kings of mocking like Maher who are put on a pedestal for their prowess in uncivil discourse.
And gun owners can certainly should lock them up and make sure the mentally ill don't have easy access to them. Perhaps we never should have lowered the bar and taught "tolerance" instead of 'brotherly love".

Dec 25 2012: But as Verble pointed out if proper responsibility had been taken in the first place then there would less of these incidents and more money and interest in making sure the right facilities and medical help was available.

Dec 25 2012: You are correct. If proper responsibility had been taken for the boy, Adam Lanza, had not his mother and an entire trained and well-paid staff of teachers, allowed him to spend days and years in school, slithering along the walls, (we now learn)...then a tormented monster would not have been formed out of what might have just been a kid that needed shelter and time to grow at his own pace...or perhaps he should have been institutionalized at some point.

However, the 2nd amendment states that the right to bear arms can not be diminished. The right is not granted by the state and is not granted by public approval, it simply delineated in the 2nd Amendment.

That being said, you will have to find a more lasting solution to your problem with a society that continues to produce twisted monsters.
For myself, I have done absolutely zero to contribute to that scenario.

I have been on a life long boycott of Hollywood cess, I have required my children to protect the weakest among us, I have required them to stand alone if necessary to forward human rights causes whenever they come within their scope.
I have not sent my children to sub-standard public schools. I have used my disposable income to make sure they are educated in civil & humane institutions that support these principles.

Therefore, no, I will not relinquish my rights to make others feel safer in a community that they have created with their own moral dereliction. If they don't like what their "main stream" has produced, let them start by cleaning in it up. The only tools they should be allowed to have is that of moral persuasion.

No, I don't think, at this point in history, it is tenable to say that we need to raise a generation of people who, are so deviant, that we need to keep sharp objects away from them. What does that say about the entire course of our so-called evolution? This shooting is the result of a vain & selfish culture, it is their chicken coming home to roost.

Dec 28 2012: An extremely selfish and ignorant woman purchased, possessed and allowed her obviously mentally deficient son to have access to those guns. What law do you propose that will negate all the effects of such people?

If you can produce the actuarials and the legacy on society of selfish and ignorant people and the legislation that will prohibit them from effecting everyone else, I'll stand by you.
